Position/Title: ERISA Attorney

 

Reports to: VP, Operations

 

Summary of Position:

Provide technical support to senior management, supervisors, consultants, administrators, clients, and clients? advisors.  (Legal opinions cannot be given to clients or their advisors.)



 

Duties and Responsibilities:

?  Alert management and staff to important developments regarding compliance issues (especially IRS procedural matters that supervisors would not normally monitor independently).

? Respond to questions regarding the qualification, design, and operation of employee benefit plans (e.g., evaluate Qualified Domestic Relations Orders), resolving complex issues arising from defects in plan documents and operation.

?  Prepare and maintain electronic templates for producing plan documents, amendments, notices, communications, cover letters, etc.

? Prepare volume and non-standardized prototype retirement plan submissions for IRS determination letters.

? Direct the activities of the compliance staff, and recommend actions to be taken by management regarding staffing, software, hardware, database management, and project management.

? Prepare client documents (volume and prototype), IRS submissions (including VCP submissions), DOL delinquent filer submissions, and take charge of special projects (e.g., voluntary compliance audits).

? Review documents and related materials prepared by other practitioners.



 

Qualifications:

15 years of related experience.  Ten years experience as an ERISA attorney (admitted to a state bar), ideally with a law firm, consulting firm or administrative service provider.  Must be proficient in the use of complex software (e.g., Visual Basic macros). Experience with Corbel documents a plus.



 

Education:

LlB or JD degree from accredited law school.
