Reports to: Associate General Counsel, Real Estate Position SummaryThe position provides legal counsel and support to the Real Estate Department and other departments of the company. Transactional work will include negotiation and drafting of real estate documentation, both in acquisitions and dispositions of company property. Underlying transactions include leasing, subleasing, lease assignments, real estate purchases and sales, and construction, with a primary emphasis on retail real estate, distribution centers and warehouse properties. Site maintenance work will require legal and factual investigation, research and analysis, and negotiation, as necessary, to resolve internal and external questions concerning common area maintenance costs, building repairs, landlord disputes, easements and other matters. Position Responsibilities1. Responsibilities include the analysis, preparation, review and revision of legal documentation to support the Real Estate Department and other departments within the company. May also be asked to participate as a team member on larger corporate transactions involving real estate issues. 2. May be asked to serve on Legal Department’s task forces formed from time to time to develop and/or implement policies or procedures with respect to new or difficult issues and may be asked to assist an Associate General Counsel serving on a similar task force organized at the corporate level.3. Serve as a legal resource to the committee or task force but the scope of his or her participation may be broader depending on experience, ability, or expertise in the area involved.4. The attorney appropriately obtains, analyzes, and documents the facts, data, documents, and applicable law necessary and pertinent to issue or project.5. In conjunction with the business client, develops and implements legal strategies which effectively address and resolve the clients' problems consistent with the law and the interests of the client, the company, and the company’s current real estate strategy.6. May review and assign legal tasks or projects to paralegals and other department personnel. Counsel may also assist or instruct other members of the Legal Department as a legal resource.7. Quantitative DimensionsHas authority to select and hire outside counsel, consultants, and other professionals as necessary for handling legal transactions. These decisions may involve multiple parties and significant costs.
Bachelor’s degree, and Juris Doctor degree from an ABA accredited law school, and 3 to 7 years of relevant real estate legal experience
Successful passage of a bar examination in the state which the attorney’s primary office is located, however, corporate counsel membership may be acceptable if the attorney is a member in good standing of the bar of another state.
