Legal Counsel

The following position within Volvo Financial Services North America (the ?Company?) reports to the  Vice President - Legal & General Counsel.

 

LEGAL COUNSEL

   

This position works with the business units of the Company by providing legal advice supporting the Company?s mission to be the premier captive finance company in the United States. This position will be responsible for providing legal support of a wide variety of commercial finance matters including bankruptcy and general litigation actions and retail and wholesale (dealer) transactions. The successful applicant will work in a collegial legal department and have immediate opportunity for increased responsibility and career growth. 



RESPONSIBILITIES:

? Working with business units in developing and implementing necessary legal policies and practices supporting effective asset finance, collection, and recovery practices

? Negotiating with internal and external customers and partners regarding documentation of the financing of commercial motor vehicles, construction equipment, and other transportation products in the United States 

? Supporting collections and asset recovery functions

? Drafting legal documentation for initial fundings, restructurings, and work-outs of troubled transactions.

? Supervision of external counsel used in bankruptcy and litigation matters

? Review of marketing and new product materials

? Special Projects

 

EDUCATION:

? JD (Doctor of Jurisprudence) from an ABA accredited school.

? Currently licensed for the active practice of law and in good standing with at least one state.

 

EXPERIENCE:

? Two to four years legal experience with exposure to creditor's rights, bankruptcy and collections practice and/or or equipment leasing/finance transactional experience

? Working knowledge of general commercial litigation, including replevins, repossessions and disposition of collateral.

? Knowledge and experience with Article 9 and Article 2A of the Uniform Commercial Code

? Franchise financing experience would be a plus.

? Familiarity with titling and lien perfection laws and regulations, as well as recovery and asset disposition (notices of sale) laws and procedures.

? Ability to provide alternative legal strategies and structures

? Excellent interpersonal and communication skills (oral and written) with all levels of staff, including senior executives

? MS Office and Word proficiency.
