CONTRACTS MANAGERS - (2) Openings

ALSTOM’s Environmental & Energy Systems (EES) Business is a global leader in the supply of power generation new equipment units and retrofit upgrades serving worldwide markets. Our clients worldwide include utilities, industry, independent power producers and government entities. We are seeking (2) Contracts Managers to join our Legal team. The positions reside in Windsor, CT reporting to the Claims Manager in the Legal Department and works closely with personnel in Projects, Purchasing, and Risk Management organizations.

 

The position is responsible for the management and administration of contracts that the company undertakes with its clients, external consortium partners, and major site subcontractors in terms of risk management, advice on commercial strategy during execution of the work, and preparation and negotiation of claims for extra time and cost, together with recovery of monies from insurers and subcontractors.  Contract Management support during the project execution phase may include the preparation and negotiation of contract amendments and variations, ensuring that the provisions of the contract are followed in all disputes (notices, substantiating documentation etc.) and that the correct legal review and approvals are obtained for formal dispute resolution (arbitration and litigation).  Focus of responsibilities will primarily be during execution phase of projects after contract award and may include assistance with handling warranty claims and disputes, but may also include negotiations during tendering phase.

 

Responsibilities include, but are not limited to:
Support the project execution start-up prior to full Notice to Proceed including contract analysis and preparation of Project Commercial Execution Plan.
Provide commercial support during the bid approval process. Ensure terms and conditions of sale and purchase are within current Corporate guidelines or appropriate levels of management have approved deviations, review/draft bid documents and prepare clarifications for commercial terms.
Assume responsibility for all project commercial activities from hand over from sales until all relevant commercial obligations are complete and all relevant commercial issues are resolved/settled.  This includes obtaining required licenses, insurance certificates, letters of credit and bonds for projects assigned.
Identify customer/consortium and other third party obligations and develop and implement Project Claim Strategy.
Ensure appropriate schedules for subcontracts are produced and maintained to support Project Claim Strategy.
Support the development of the project risk and opportunity identification and analysis.
Support the management of risks and opportunities by developing and implementing appropriate commercial action plans.
Preserve ALSTOM?s rights and entitlements as provided in the Contract and ensure proper notices are given in line with contract requirements. 
Manage claims to and from customers and consortium partners and support management of claims to and from contractors and sub-suppliers as required and control back-charges from site and ensure appropriate recovery from third parties and/or refuting claims of subcontractors.
Manage customer variation requests and orders, project insurances, submission, monitoring and settlement of insurance claims in accordance with policies.
Establish and implement project specific commercial procedures particularly with regard to claims, insurance, correspondence and notifications.
Support and guide the project team on general contract issues and clarification of contractual and legal queries, if required by referring to Legal.
Provide commercial management support as required in the event of a potential dispute.
Assists the Project Manager in contract close-out procedures to ensure that all terms and conditions of contracts have been complied with and the Company is able to obtain final payment from customer and the return of any financial securities.
Undertake any other commercial tasks as instructed or requested by the Project Director and/or management.

 

Qualifications:
Bachelor's degree in Commercial Law, Business or applicable educational discipline.
Minimum of 5+ years? experience of project commercial work in an engineering or construction environment with direct experience in contract negotiations, claims management, contract administration, purchasing, or project management.
Strong commercial experience of contracts including contract drafting and the ability to identify and understand the salient points and issues. General knowledge of contract and commercial law/sale of goods; knowledge of engineered products and construction processes.
Must be able to assimilate contractual and legal issues quickly and have a sound track record of successful management of claims.
Experience working in an international environment is a plus. Significant international and domestic travel to project sites is required.
The ideal candidate must be analytically minded, able to pay strict attention to details, work independently, manage multiple tasks with minimal supervision, meet tight deadlines and adapt quickly to changing demands from customers and/or contract/project requirements.
Good interpersonal and strong communication skills with a willingness to challenge others with an effective ability to influence others over whom you have no direct authority.
Self-motivated, capable person with strong interpersonal skills and initiative to work alone as well as in a team.
Strong problem solving, computer, communications and organizational skills.
