Liability Claims Examiner II

POSITION PURPOSE

Reviews, investigates, analyzes and makes recommendations based on claims against the Company for accidental death or injury to persons or employees and private property damages. Determines claim value and decides whether to pay or decline a claim within prescribed authority.  Attempts to effect out-of-court settlement with the claimant through negotiation.  Attempts to reduce insurance costs and losses.  May actively pursue the collection of the loss (any expenses incurred to USX or CSI Crown due to someone else?s negligence) when there is damage to our equipment (cargo, tractors, trailers).  Supervises and directs claims involving litigation and outside defense counsel.

 

JOB FUNCTIONS

Handles calls from the general public regarding damage to personal property.Interviews, telephones or corresponds with claimant and witnesses; Consults police and hospital records; Provides on-site adjuster to give caller directions on how to handle the situation.Examines claim form and other records to determine the responsible party for the accident (spill, rollover, etc.), cargo or equipment damage or loss; Reviews Bill of Ladings to determine proof of deliveries in the establishment of legitimate claims. Inspects or consults with on-site adjuster who inspects property damage in order to determine extent of company liability.Prepares report of findings and negotiates settlement with claimant, or as directed by the Director of Claims.  Makes Check Requests.  Handles rebuttal claims.Recommends litigation to legal department when settlement cannot be negotiated.Coordinates with on-site adjuster and our Maintenance department to provide wrecker services or transloading of shipments.Mentors, provides training and/or guidance to Claims Coordinators.May actively pursue the collection of the loss (any expenses incurred to USX or CSI Crown due to someone else?s negligence) when there is damage to our equipment (cargo, tractors, trailers).Supervises and directs claims involving litigation and outside defense counsel.  Attends Safety Review Meetings.

 

 

KEY KNOWLEDGE AND EXPERIENCE

 Any combination of education or experience equivalent to a two year degree.Certified Claims Professional Certificate preferred.3 - 5 years of experience (Risk, Insurance, Trucking Industries)Strong Telephone Communication and Negotiation/Consulting SkillsStrong Reasoning and Analytical Skills
